SafeTripVax Terms of Service

Effective date: 2026-02-07

1. General information

These Terms of Service ("Terms") govern the use of the SafeTripVax service available at https://safetripvax.com (the "Service").

The owner and operator of the Service is EPKO sp. z o.o. (ul. Podleśna 2, 05-270 Marki, Poland, KRS: 0000908693, NIP: 1251720637, REGON: 389307530) (the "Administrator").

Medical disclaimer: SafeTripVax does not provide medical services, diagnoses or medical advice. Content in the Service is informational and educational and does not replace consultation with a qualified healthcare professional.

Separate agreements: If you contact or use services of a clinic listed in the Service, you conclude any medical-service agreement directly with that clinic. SafeTripVax is not a party to such agreements.

What SafeTripVax does (and does not do)

  • We provide a technical platform to browse and compare information (including user- and clinic-provided content).
  • We may moderate content to reduce illegal or harmful material and to improve information quality.
  • We do not verify medical qualifications, licenses or clinical outcomes unless explicitly stated for a specific feature.
  • We do not guarantee that any clinic, offer or user opinion is accurate, complete or up to date.

Urgent situations

  • For emergencies, call your local emergency number (in Poland and the EU: 112).
  • Do not rely on the Service for emergency or time-critical medical decisions.

2. Definitions

Key terms used in these Terms

  • User – any person using the Service.
  • Patient – a User seeking information about vaccines, diseases, clinics or travel health.
  • Clinic – an entity that maintains a profile or publishes information in the Service.
  • Account – a User profile enabling access to additional features.
  • Content – text, images, reviews and other materials available in the Service.

3. Account and permitted use

Creating an Account may be required for selected features. You must provide accurate and up-to-date information and keep your login credentials secure.

You may use the Service only in accordance with applicable law and these Terms. We may suspend or restrict access in case of abuse, security risk or violation of these Terms.

Prohibited actions

  • Posting illegal content, personal data of third parties without a legal basis, or content that infringes intellectual property rights.
  • Impersonation, fraud, manipulation of ratings/reviews, or automated scraping that disrupts the Service.
  • Attempting to compromise security, introduce malware, or interfere with the Service's operation.

Age requirements

  • You must be at least 16 years old to create an Account or use features that involve personal data processing (in accordance with GDPR Article 8 and Polish data protection law).
  • If you are under 16, you may only use the Service with the consent and supervision of a parent or legal guardian.

Account deletion and data portability

  • You may request deletion of your Account at any time via your account settings or by contacting us at [email protected]. We will process such requests in accordance with GDPR Article 17 (right to erasure).
  • You have the right to receive your personal data in a structured, commonly used and machine-readable format (GDPR Article 20 – data portability).
  • Certain data may be retained after account deletion where required by law (e.g., tax and accounting records, data necessary to establish or defend legal claims).

4. User content, reviews and moderation

If you publish Content in the Service, you are responsible for it and confirm you have the necessary rights and permissions.

We aim to reduce misinformation and abuse, but we cannot guarantee authenticity of every review or listing. Content may be removed or limited if it violates law or these Terms.

License for user content

By publishing Content, you grant the Administrator a non-exclusive, worldwide, royalty-free license to host, display, process and moderate that Content for the purpose of operating and improving the Service. The license ends when the Content is removed, except that we may retain limited backups for legal and security purposes.

Reporting

  • If you believe Content violates law or your rights, contact us at [email protected] with a description and a link/screenshot.
  • For copyright-specific reports, use the dedicated report flow available in the Service.

Content moderation practices (Digital Services Act)

  • In accordance with the EU Digital Services Act (Regulation 2022/2065), we apply the following content moderation measures: automated detection of spam and prohibited content, manual review by trained moderators, and user-driven reporting.
  • Decisions to restrict or remove Content are based on these Terms, applicable law and our content policies. We strive to act proportionally and to respect fundamental rights, including freedom of expression and information.
  • If your Content is removed or your Account is restricted, you will be notified with a clear statement of reasons and the legal or contractual basis for the decision, unless notification is not possible for legal or safety reasons.

Internal complaint mechanism (DSA Art. 20)

  • If you disagree with a content moderation decision (removal of Content, restriction of visibility, or suspension of your Account), you may submit a complaint by email to [email protected] within 6 months of the decision.
  • Complaints are reviewed by a qualified person who was not involved in the original decision. We will inform you of the outcome without undue delay.
  • If we reverse a decision, we will promptly restore the Content or access. You also have the right to refer the matter to a certified out-of-court dispute settlement body or to seek judicial redress.

Algorithmic recommendations

Where the Service uses automated systems to recommend or rank content (e.g., clinic listings, search results, health information), the main parameters include: relevance to your search query, geographic proximity, user ratings and reviews, and data completeness. These recommendations are not based on profiling of the User within the meaning of GDPR Article 22. 5. Paid services and payments (if applicable)

Some features may be offered for a fee (e.g., subscriptions or premium tools). If a feature is paid, the price, scope and billing period are shown before purchase.

Payments may be processed by third-party payment providers (e.g., Stripe). Depending on your plan, recurring charges may apply until you cancel.

Consumer rights (including withdrawal rights where applicable) depend on your country and the type of digital service.

Right of withdrawal (EU consumers)

  • If you are a consumer in the EU/EEA, you have the right to withdraw from a distance contract for paid services within 14 days of concluding the contract, without giving any reason (Directive 2011/83/EU on consumer rights; Polish Act of 30 May 2014 on Consumer Rights, Art. 27).
  • To exercise this right, send a clear written statement (e.g., by email to [email protected]) before the 14-day deadline expires. You may use the model withdrawal form in Annex I to Directive 2011/83/EU or a withdrawal form available in your account settings.
  • If, at your explicit request, we begin providing a digital service before the withdrawal period expires, you will be asked to acknowledge that you thereby lose the right of withdrawal once the service has been fully performed (Art. 38 point 13 of the Polish Act on Consumer Rights).
  • Refunds will be issued within 14 days of receiving your withdrawal notice, using the same payment method as the original transaction, unless you expressly agree otherwise. No additional fees will be charged for the refund.

6. Intellectual property

Unless stated otherwise, the Service's software, design and original content are protected by intellectual property laws and belong to the Administrator or licensors.

You may not copy or reuse protected materials beyond what is permitted by mandatory law, without prior permission.

7. Liability

The Service is provided "as is". To the extent permitted by law, we are not liable for indirect damages, lost profits, or health outcomes arising from relying on information in the Service or from services provided by clinics.

Nothing in these Terms excludes liability that cannot be excluded under mandatory law (including liability for willful misconduct or personal injury where applicable).

8. Personal data and cookies

Personal data processing and cookie usage are described in the Privacy Policy and Cookies Policy available in the Service.

9. Complaints and disputes

You can submit complaints about the Service by email to [email protected]. We will respond within a reasonable time, and no later than within 14 days where required by applicable law.

Out-of-court dispute resolution

  • Consumers in the EU may use the EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
  • In Poland, consumers may also seek out-of-court resolution through: (a) mediation by the Provincial Inspector of the Trade Inspection (Wojewódzki Inspektor Inspekcji Handlowej); (b) a permanent consumer arbitration court (stały polubowny sąd konsumencki) at the Provincial Inspector of the Trade Inspection; (c) municipal or county consumer ombudsmen (powiatowy/miejski rzecznik konsumentów).
  • A list of certified ADR (alternative dispute resolution) entities in Poland is maintained by the Office of Competition and Consumer Protection (UOKiK) at https://uokik.gov.pl.
  • Using out-of-court dispute resolution is voluntary. Neither party is obliged to accept the outcome unless they expressly agree to do so.

10. Changes and final provisions

We may update these Terms for important reasons (e.g., legal changes, security, new features). We will inform you in advance when required.

Supported language versions: en, pl, de, fr, es, ar, sw, ja, pt-br, pt-pt, id, ha, hi, ru, tr. In case of discrepancies, the Polish version prevails.

Governing law: Polish law, unless mandatory consumer protection rules of your country provide otherwise.
